There are three main outcomes from a Court Repossession Hearing. Our aim is to achieve a Suspended Order.

  1. Suspended Possession Order
    This allows you to keep your home indefinitely, providing you adhere to the agreed terms which are ordered by the District Judge.
  2. Possession Order
    This order is granted in favour of the Mortgage Lender. This type of order will usually be issued if you have failed to attend the first hearing. A 28–day order will normally be issued (but this could be up to 72 days) which allows the homeowner a set time to clear the mortgage arrears, leave the property, or make an alternative arrangement. Failure to comply with this order means that the Lender will take you back to court to obtain an Eviction Order, without a hearing which will ultimately mean that you and your family will be removed from the property.   3. Adjournment
    The Judge can request an adjournment for the purpose of gathering further information in respect of the case, for you or the lender to produce at a further hearing at a later date.
